Steps for WorkCover Compensation Claims
In understanding WorkCover compensation claims, there are several steps that a claimant must go through when lodging a claim to WorkCover.
The injured worker must lodge a Workcover claim within 6 months from the date of incident
Workcover will pay medical expenses and weekly benefits (for time off work) and any other rehabilitative expenses.
Workcover will organise host employment with suitable duties for the claimant’s injuries if the claimant is struggling to return to work.
The claimant’s injuries will be assessed for degree of permanent impairment by an independent medico-legal expert.
The claimant will receive a Notice of Assessment with an offer (it is very important for you to speak to a lawyer PRIOR to accepting this offer. You may lose your entitlements to lodge a Common Law claim for a more significant compensation)
What You Need to Do for a WorkCover Compensation Claim
Notify your employer as soon as possible after the injury has occurred
Obtain a workers compensation medical certificate from a medical practitioner as soon as possible. This certificate must outline the nature of your injury and how it occurred.
Submit your workers compensation certificate to Workcover QLD or your employer’s insurance representative (if they are self-insured). You can do this online or by phone.
What Happens Next With My Workers Compensation Claim?
Once your claim has been lodged, Workcover QLD or the insurer will assess your claim and decide whether it is compensable under the workers compensation scheme.
If your claim is accepted, you will receive benefits to cover medical expenses and weekly payments if you are unable to work due to your injury.
If your claim is rejected, you have the right to appeal the decision with the Workers Compensation Regulator. If they uphold the original decision then you may appeal to the Queensland Industrial Relations Commission.
